Immigration Equality and Partner Organizations Issue a Practice Advisory on Trans Asylum Claims in Response to the Trump Administration’s Anti-Trans Executive Orders and Policies

Asylum claims based on gender identity are clearly established by decades of law in the United States, and transgender asylum seekers have long been successful in claims for humanitarian protection. However, due to recent transphobic Executive Orders issued by the Trump administration that attempt to illegally strip rights away from transgender people, advocates have voiced concern that the Trump administration may also seek to illegally limit asylum claims for trans people. In response, Immigration Equality, The National Immigration Project, Oasis Legal Services, the National Immigrant Justice Center, and Ready to Stay authored a practice advisory on how to frame asylum claims for transgender people in light of these Executive Orders and related policy changes. In addition to the practice advisory, the National Immigration Project, Immigration Equality, and Ready to Stay have created a Template Legal Brief for transgender asylum applicants.
